Joe, To support the NRCs development of the Environmental Assessment and its consultations among parties with an interest in the potential effects of TVAs exemption request for excavation activities on historic properties, TVA is providing the following responses (Red Text) to the request for confirmation of information related to historic and cultural resources.

HCR RCI-01

1. Confirm that the onsite direct and onsite indirect APEs for the exemption request are the same APEs as analyzed in the ESP EIS (ML19087A266) and, that the offsite APE is no longer applicable to the proposed CRN-1 project and the exemption request.

TVAs Response: The onsite direct and onsite indirect APEs for development of the CRN Site and construction of CRN-1 are unchanged from those described and documented in the ESPA ER and the NRC ESP FEIS. TVA has completed consultation on the CRN-1 project and, therefore, is not consulting separately on the early excavation effort. As a result, TVA has not defined separate onsite APEs for activities associated with the exemption request.

The offsite APE described in the NRC ESP FEIS resulted from the proposed addition of a bypass flow system through an existing part of the Melton Hill Dam structure to maintain a minimum flow to support power operations, and therefore, is not applicable to the activities associated with the exemption request. Applicability of the offsite APE to the proposed CRN-1 project will be addressed in TVAs Environmental Report associated with a Construction Permit Application.

2. Confirm that all activities associated with the exemption request are within the onsite direct APE, including but not limited to:
a. roadwork necessary to conduct activities pursuant to the exemption (e.g., any ground-disturbing activity, including but not limited to improvements; maintenance, such as grading; relocation.)

TVAs Response: Confirmed. Roadwork necessary to conduct activities associated with the exemption request are within the onsite direct APE.

b. new/relocated/improved utilities necessary to conduct activities pursuant to the exemption (e.g., any ground-disturbing activity, including but not limited to improvements; maintenance, such as grading; relocation.)

TVAs Response: Confirmed. New, relocated, or improved utilities necessary to conduct activities associated with the exemption request are within the onsite direct APE.

3. Confirm that none of the activities associated with the exemption request would overlap, intersect, or otherwise impact historic and cultural resources (eligible or ineligible for listing in the National Register of Historic Places.)

TVAs Response: Confirmed. The CRN-1 RB excavation and installation of the initial ground support system is confined to a small portion of the CRN-1 site previously disturbed during the construction activities associated with the former Clinch River Breeder Reactor Project (CRBRP). There are no activities associated with the exemption request that would overlap, intersect, or otherwise impact historic and cultural resources.

There are no National Register of Historic Places (NRHP)-listed, eligible, ineligible, or potentially eligible historic properties or archaeological sites that could potentially be impacted by activities associated with CRN-1 RB excavation and installation of the initial ground support system.

David, On November 30, 2023, the TVA submitted an exemption request (ML23335A100) to the NRC for excavation activities at the Clinch River Nuclear Site prior to the issuance of a construction permit which NRC accepted January 31, 2024 (ML24009A168). Related to excavation activities, NRC is developing an environmental assessment (EA) and requests confirmation and/or clarification of HCR RCI-01 (below) to assist in the EA development by facilitating NRCs prompt initiation of consultation among parties with an interest in the potential effects of the undertaking on historic properties. As such, NRC requests a response on or before next Wednesday, June 19th.
