AMENDMENT NO. 06 TO RADIOACTIVE MATERIALS LICENSE FOR NIOWAVE, INC., NRC LICENSE NO. 21-35144-04

Dear Dr. Peters:

Enclosed is Amendment No. 06 to your U.S. Nu clear Regulatory Commission (NRC) Materials License No. 21-35144-04 in accordance with your request dated April 15, 2024. Specifically, you requested changes for the licensed material and use and users in the license. Your request is available electronically from the Agencyw ide Documents Access and Management System (ADAMS) at Accession No. ML24107B048 (non-public).

For your information, your license is authorized for NIST traceable calibration source(s) containing polonium-209 in Item 6.Z. of the license. This was added to your license in Amendment 4 based on your request dated November 18, 2022. However, Table 6.1. of your application showed it as lead-209. Please verify your inventory and make correction, if needed, to ensure you are in compliance with terms and c onditions of the license. Additionally, based on the changes in the licensed material and use, the program codes for your license have been changed. This change will impact your annual license fee and inspection frequency. An environmental assessment for this action is not required because this action is categorically excluded under Title 10 of the Code of Federal Regulations (CFR) Section 51.22(c).

You will be periodically inspected by NRC. Failure to conduct your program in accordance with NRC regulations, license conditions, and representa tions made in your license application and supplemental correspondence with NRC will result in enforcement action against you. This could include issuance of a notice of violatio n; or imposition of a civil penalty; or an Order suspending, modifying, or revoking your lice nse as specified in the NRC Enforcement Policy.
