TERMINATION OF QUALITY ASSURANCE PROGRAM APPROVAL FOR RADIOACTIVE MATERIAL PACKAGES NO. 0170, REVISION 12
Dear Scott Murray:
As requested in your letter to the U.S. Nuclear Regulatory Commission (NRC) dated April 24, 2024 (Agencywide Documents Access and Management System [ADAMS] Accession No. ML24115A078, non-public), Quality Assurance Program Approval No. 0170, Revision 12, for Vallecitos Nuclear Center QAP-1, Quality Assurance Program for Shipping Packings for Radioactive Material, is hereby terminated and replaced by Quality Assurance Program Approval No. 0254, Revision 13, for NEDO-11209-A, GE Hitachi Nuclear Energy Quality Assurance Program Description (QAPD). You are no longer authorized to design, procure, fabricate, assemble, test, modify, maintain, repair, or use radioactive material packagings under Approval No. 0170. The requirements of Title 10 of the Code of Federal Regulations (10 CFR)
Part 71, Subpart H, Packaging and Transportation of Radioactive Material, Quality Assurance, shall be met through implementation of the NEDO-11209-A under Approval No. 0254.
As discussed in the NRCs approval letter dated November 23, 2022 (ML22325A355), Approval No. 0254, Revision 13 satisfies the requirements of 10 CFR 71.17(b) and 71.101(c) for a quality assurance program approved by the NRC, as well as approval of those changes to your quality assurance program that are considered reductions in commitments to the NRC prior to implementation, as required by 10 CFR 71.106. Therefore, your authorization to perform quality activities for radioactive material packages was maintained.
This letter also serves as a reminder that if you are using or planning to use an NRC-approved packaging, you must be registered for use of that packaging with the NRC. Registration for use of NRC-approved packagings should be made pursuant to 10 CFR 71.17(c)(3).
In accordance with 10 CFR Part 2, Agency Rules of Practice and Procedure, a copy of this letter will be available electronically for public inspection in the NRC Public Document Room (PDR) or from the Publicly Available Records component of the NRCs Agencywide Documents ADAMS. ADAMS is accessible from the NRC website at http://www.nrc.gov/reading-rm/adams.html. The PDR is open by appointment.
