REQUEST: State review of an NRC environmental assessment for the South Texas Project

Hello Robert, I am sending you, earlier than expected, an environmental assessment for an exemption in accordance with Title 10 of the Code of Federal Regulations 72.7 from certain requirements

applicable to the use of HI-STORM 100 Cask System or the HI-STORM Flood/Wind (FW) Multi-purpose Canister (MPC) Storage System. This request is for the South Texas Project Electric Generating Station, Unit 1 and Unit 2. Please review the attached draft environmental assessment and let me know if you have any comments by Monday, June 17, 2024. I apologize for the quick turnaround on this matter.

Please let me know if you are able to review this document within the requested timeframe.

Also, feel free to call or email me if you have any questions.

Best, Jill Caverly

Upcoming request for State comments regarding an environmental assessment for the South Texas Project

Dear Robert Free:

I am writing to you on behalf of the U.S. Nuclear Regulatory Commission (NRC) regarding a licensing action for the South Texas Project Unit 1 and Unit 2 in Bay City, Texas. The purpose of this email is to alert you to an upcoming draft environmental assessment (EA) that the NRC will send to you in advance of a licensing decision. The NRCs licensing action associated with this EA is high-priority and time sensitive, and we plan to send you the draft EA by June 6, 2024. If you have any comments regarding the information in the EA or the NRCs proposed licensing action, we will be requesting that you provide them as soon as possible, but no later than ten days after receiving the EA.

The NRC staff is developing the EA to assess the impacts to the environment from the proposed action, which is an exemption, in accordance with Title 10 of the Code of Federal Regulations 72.7, from certain requirements applicable to the use of HI-STORM 100 Cask System or the HI-STORM Flood/Wind (FW) Multi-purpose

Canister (MPC) Storage System. Specifically, STP Nuclear Operation Co. is requesting an exemption from requirements that would prevent them from being able to store spent fuel in certain spent fuel storage systems that contain a design variant that has not yet been approved by the NRC.

If I have incorrectly identified you as the appropriate reviewing officials, I kindly ask that you direct me to the appropriate State official for review of this matter. Please feel free to contact me or my colleague, Christine Pineda (copied), if you have questions or concerns.

Sincerely, Jill Caverly

Jill S. Caverly PE Civil Engineer Senior Project Manager US Nuclear Regulatory Commission 301-415-7674 Jill.Caverly@nrc.gov
