UNITED STATES NUCLEAR REGULATORY COMMISSION WASHINGTON, D.C. 20555-0001 June 28, 2024 RESPONSE TO THE OFFICE OF THE INSPECTOR GENERAL'S SPECIAL INQUIRY INTO THE APPEARANCE OF A CONFLICT OF INTEREST INVOLVING MEMBERS OF THE ADVISORY COMMITTEE ON THE MEDICAL USES OF ISOTOPES (OIG CASE NO. 12200187)

The staff received the Office of the Inspector General's (OIG) report for Special Inquiry into the Appearance of a Conflict of Interest Involving Members of the Advisory Committee on the Medical Uses of Isotopes (ACMUI) (OIG Case No. 12200187) (Agencywide Documents Access and Management System Accession No. ML24089A057), dated March 26, 2024. As noted in the OIG report, advisory committees, such as the ACMUI, are made up of experts who provide independent advice that supports agency decision-making processes. As experts in their respective medical fields, affiliations with professional organizations are expected for members of the ACMUI. Based on the findings of the OIG's special inquiry of appearances of conflict of interest for ACMUI members' active roles in such organizations, the staff conducted a thorough review of its policies to identify program enhancements to ensure continued avoidance of current and future conflicts of interest and the appearance of conflicts of interest for ACMUI members.

The U.S. Nuclear Regulatory Commission (NRC) staff reviewed internal procedures for administering and coordinating activities of the ACMUI, ACMUI bylaws, and information provided to the ACMUI in publications and trainings. The NRC staff identified program enhancements to ensure that the staff's processes are consistent with the Federal Advisory Committee Act, Title 10 of the Code of Federal Regulations, Part 7, "Advisory Committees," and Management Directive 10.12, "Use of Advisory Committee Members." In addition to the program enhancements identified in the enclosure, the staff is also assessing the potential use of the Advisory Committee on Reactor Safeguards' WebACTS platform to track ACMUI matters, including members affiliations with professional organizations and conflict-of-interest screenings. The staff has engaged the ACRS staff and will provide a future status update on this effort.
