OF MEETING BETWEEN THE U.S.

NUCLEAR REGULATORY COMMISSION STAFF AND THE CALIFORNIA STATE HISTORIC PRESERVATION OFFICE (DOCKET NUMBERS: 50-275 AND 50-323)

On April 4, 2024, the U.S. Nuclear Regulatory Commission (NRC) staff held a virtual meeting with the California State Historic Preservation Office (CA SHPO) senior state archaeologist based in Sacramento, CA. The CA SHPO is a consulting party pursuant to Title 36 of the Code of Federal Regulations Section 800.2(c)(1) regarding two undertakings: the proposed license renewal (LR) of the operating licenses for Diablo Canyon Power Plant (DCPP) Units 1, 2 and LR of the DCPP Independent Spent Fuel Storage Installation.

During the meeting, the NRC staff provided a summary of the March 2024 in-person consultation meetings with the Santa Ynez Band of Chumash Indians and the yak tityu tityu yak tiłhini Northern Chumash Tribe, as well as a summary of discussions held with Pacific Gas &

Electric (PG&E). Additionally, the NRC contract archaeologist presented slides and led discussions regarding survey work that has occurred at the DCPP site. The NRC staff also provided a brief presentation regarding future decommissioning, and operations and maintenance of the DCPP site during the LR review.

CA SHPO representative recommended that the current 750-acre area of potential effect (APE) be expanded to encompass the entirety of the Rancho Historic District because the district may be impacted by the undertaking. NRC explained that the 750-acre APE will be considered during LR as that is within NRCs regulatory control. The NRC plans to submit for concurrence a recently updated Rancho Historic District nomination form during the DCPP LR process.

During LR, only the incremental impacts of decommissioning as a result of the period of extended operations are considered, i.e., whether an additional 20 years of operations would have an effect on that eventual decommissioning. In its review of the DCPP Post-Shutdown Decommissioning Activities Report, submitted by PG&E in 2019, the NRC staff determined that two of the eligible sites (SLO-2 and SLO-61) could be impacted by decommissioning. The NRC staff clarified that, in accordance with NRC regulations, PG&E will not perform any decommissioning activities that would result in significant impacts to cultural resources without prior review. Such actions would require NRC review and approval of a license amendment request, which would be a separate undertaking with a separate environmental assessment or environmental impact statement that would initiate a Section 106 consultation to seek appropriate input. The NRC staff also explained that there is an environmental protection plan incorporated directly into the DCPP operating licenses that outlines specific protections for the SLO-2 site. Therefore, even outside of decommissioning, the NRC would need to review any action that could potentially result in disturbance to that site.

The CA SHPO representative indicated a need for an agreement to enforce the properties management plan.
