SUMMARY

OF MEETING BETWEEN THE U.S. NUCLEAR REGULATORY COMMISSION STAFF AND THE YAK TITYU TITYU YAK TI*HINI NORTHERN CHUMASH TRIBE

On March 21, 2024, the U.S. Nuclear Regulatory Commission (NRC) staff held a meeting with representatives from the yak tityu tityu yak tiłhini Northern Chumash Tribe (YTT). YTT requested to be a consulting party for both the proposed license renewal (LR) for Diablo Canyon Power Plant Unit 1 and Unit 2 (DCPP) and the LR for Diablo Canyon (DC) Independent Spent Fuel Storage Installation (ISFSI). The NRC staff will consult with the YTT pursuant to Title 36 of the Code of Federal Regulations Section 800.2(c)(5). Only the NRC staff and YTT representatives were present.

During the meeting, the NRC staff discussed NRCs LR, environmental and cultural resources review processes, development, and history of DCPP and the DC ISFSI LR undertaking and anticipated next steps. The NRC staff shared that for the DCPP LR is in the early phase of the review process and provided dates and methods available for engagement on the undertaking.

Additionally, the NRC staff explained the schedule for the DC ISFSI LR.

The YTT discussed their sovereignty, and the rights afforded them due to their demonstrated ancestral ties to the land. They shared concerns that the Federal and State agencies consult with Tribes who do not have ancestral ties to the DC Lands. The Tribe expressed their concerns for the land south of the DC Lands called Wild Cherry Canyon.

Additionally, the YTT discussed their desire for an agreement that would require an additional archaeological survey for mitigation of past damage and provide further identification.
