LETTER FROM AEROTEST OPERATIONS, INC. REGARDING DEMAND FOR DAMAGES BEFORE FILING LAWSUIT
Dear Dr. Slaughter:
On behalf of the U.S. Nuclear Regulatory Commission (NRC), I am responding to your letter dated May 17, 2024 (Agencywide Documents Access and Management System Accession No. ML24145A122).
On May 4, 2023, the NRC responded to your March 29, 2023, letter lodging a claim for damages (ML23094A070). As you note, your February 21, 2024, letter was acknowledged by the agency (ML24060A057); a formal response was not provided because it did not raise any new claims or material information to warrant a different conclusion. The NRC has reviewed your May 17, 2024, letter; it likewise raises neither new claims n or material information that compel a different conclusion. As previously stated, the NRC is not aware of any factual or legal basis to support your claims for damages. The NRCs May 4, 2023, letter explicitly served as the notification of a final denial under 10 C.F.R. § 14.37, Final D enial of Claims. For your convenience, I am enclosing a copy of that letter.
