DEEP FISSION, INC. - ASSIGNMENT OF PROJECT NUMBER AND EXPLANATION OF BILLING AND FEES

Dear Dr. Muller:

By letter dated March 22, 2024, (Agencywide Documents Access and Management System (ADAMS) Accession No. ML24135A162) Deep Fission, Inc. (Deep Fission) outlined its plans for interactions with the U.S. Nuclear Regulatory Commission (NRC) staff during pre-application activities associated with the Deep Fission pressurized light water reactor.

Based on the contents of that letter, the NRC staff understands that Deep Fission intends to engage in pre-application activities through September 2026.

To facilitate these pre-application activities, the NRC staff assigned Deep Fission a project number. As such, Deep Fission should reference project number 99902126 in all future correspondence supporting pre-application licensing activities with the NRC staff. The NRC staff time devoted to activities conducted specifically in support of Deep Fissions anticipated application(s) will be charged to this project number. This is pursuant to Title 10 of the Code of Federal Regulations (10 CFR) Part 170, "Fees for Facilities, Materials, Import and Export Licenses, and Other Regulatory Services Under the Atomic Energy Act of 1954, as Amended."

Pre-application activities and activities associated with the review of a license application will be billed in accordance with 10 CFR Part 170. Following the issuance of a license, Deep Fission will also be billed, as applicable, an annual fee in accordance with 10 CFR Part 171, "Annual Fees for Reactor Licenses and Fuel Cycle Licenses and Materials Licenses, Including Holders of Certificates of Compliance, Registrations, and Quality Assurance Program Approvals and Government Agencies Licensed by the NRC."
