SUMMARY

OF MEETING BETWEEN THE U.S.

NUCLEAR REGULATORY COMMISSION STAFF AND THE yak tityu tityu yak tiłhini NORTHERN CHUMASH TRIBE On April 5, 2024, the U.S. Nuclear Regulatory Commission (NRC) staff held a video meeting with representatives from the yak tityu tityu yak tiłhini Northern Chumash Tribe (YTT). YTT is a consulting party for both the proposed license renewal (LR) for Diablo Canyon Power Plant Unit 1 and Unit 2 (DCPP) and the Independent Spent Fuel Storage Installation (ISFSI). The NRC staff, NRC contractors and YTT representatives were present.

During the meeting, the YTT explained their desire for more information regarding existing cultural resources and archaeological surveys, including, what has been observed during the surveys regarding, plants, human remains and evidence of village sites. They are also interested in what still remains undisturbed on the site, expressing that even though there was substantial disturbance during construction there is high potential that artifacts still remain.

The tribal members also indicated they would like to participate in future surveys; to complete additional digging and site identification in an obtrusive way. Currently, the DCPP site (Parcel P) is designated as a brownfield. As a brownfield site future industrial construction could occur on the site. The tribal members indicated it would be better designated as a greenfield site so that future construction did not occur.

The tribal members asked if the NRC could provide preconstruction photos and past survey documents so that they could have a more complete record of the surveys conducted.

Additionally, they are interested in maps that contain an overlay of the sites that have been identified within the DCPP site. The Tribe shared that they are participating in surveys taking place in the intake cove, which are allowing them to see the marine terraces. discussed their desire for an agreement or license condition that would require an additional archaeological survey for mitigation of past damage and provide further identification.

The ISFSI was discussed briefly. The tribal members shared concerns that future actions to modify the pad for the new canister mausoleum and the need for a concrete batch plant that might be located on the Diablo Canyon site could impact cultural resources. The NRC staff explained that this modification was not part of the current ISFSI LR undertaking.

Following the meeting, the NRC staff requested the surveys, maps, and photos from Pacific Gas and Electric Company (PG&E), who indicated they would provide. On May 15, 2024, PG&E notified the NRC that the requested items were provided.
