Westinghouse Submittal of Draft International Atomic Energy Agency Design Information Questionnaire
Dear Jo Anna Bredenkamp:
The U.S. Nuclear Regulatory Commission (NRC) has voluntarily assessed the submittal draft International Atomic Energy Agency (IAEA) Design Information Questionnaire (DIQ) from Westinghouse Electric Company, LLC (Westinghouse). The IAEA DIQ - Generic AP1000 Plant was transmitted by letter dated February 4, 2023 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML23034A181).
The NRC staff notes that the AP1000 design mentioned in the DIQ submitted by Westinghouse has not been selected by the IAEA for the implementation of Safeguards in the United States. As with all nuclear power plant licensees, a future licensee with an AP1000 design may at some time be selected by IAEA and would be required to submit a DIQ. As stated in Title 10 of the Code of Federal Regulations (10 CFR) Part 75, Westinghouse is not required to submit set DIQ and the NRC staff is not required to review set DIQ. Therefore, the NRC staff conducted this review voluntarily in accordance with the US/IAEA Voluntary Offer Agreement and the regulations set forth in 10 CFR 75. A report documenting the NRCs staff feedback and observations for the DIQ submitted by Westinghouse is provided in the enclosure.
Additionally, the feedback and observations provided by NRCs staff does not imply that the NRC has thoroughly reviewed the set DIQ for any future requirements under 10 CFR 75. For any future selection by IAEA for the implementation of safeguard in the United States, the staff will perform a full review without referencing the attached feedback and observations.
In accordance with 10 CFR 2.390 of the NRCs Agency Rules of Practice and Procedure, a copy of this letter will be available electronically for public inspection in the NRC Public Document Room (PDR) or from ADAMS. ADAMS is accessible from the NRC website at:
