U.S. DEPARTMENT OF COMMERCE, NATIONAL INSTITUTE OF STANDARDS AND TECHNOLOGY-2022 DECOMMISSIONING COST ESTIMATE AND DECOMMISSIONING FUNDING PLAN TRIENNIAL UPDATE SUBMITTAL - ENTERPRISE PROJECT IDENTIFICATION NUMBER L-2023-RNW-0017
Dear Dr. Locascio:
By letter dated September 27, 2022 (Agencywide Documents Access and Management System
[ADAMS] Accession No. ML22293A269), you submitted the triennial update to the U.S.
Department of Commerce, National Institute of Standards and Technology (NIST),
Decommissioning Cost Estimate (DCE) and Decommissioning Funding Plan (DFP), for its laboratories located in Gaithersburg, Maryland, for U.S. Nuclear Regulatory Commission (NRC) review and approval. The updated DCE/DFP was submitted in accordance with the requirements in Title 10 of the Code of Federal Regulations (10 CFR), Paragraphs 30.35, Financial assurance and recordkeeping for decommissioning, (e)(2) and 70.25, Financial assurance and recordkeeping for decommissioning, (e)(2). Your submittal was supplemented by letters dated January 24, 2023 (ML23060A262), May 16, 2023 (ML23136B278), and January 10, 2024 (ML24022A295). The NIST finally submitted an updated 2023 DCE on May 16, 2023 (ML23136B278). The NRC staff accepted your submittals for detailed technical review by letter dated June 14, 2023 (ML23157A267).
We have completed our review of your submittals. Based on the review of the information you provided, the NRC staff found that the updated DCE/DFP satisfies the requirements of 10 CFR 30.35(e)(1) and 10 CFR 70.25(e)(1), is consistent with the guidance in NUREG-1757, Consolidated Decommissioning Guidance: Financial Assurance, Recordkeeping, and Timeliness, Vol. 3, Rev. 1, dated February 2012 (ML12048A683), and is, therefore, acceptable.
A technical evaluation report for the analysis of the updated DCE/DFP is enclosed.
Within 30 days of the date of this letter NIST must submit a copy of its final 2022 DCE/DFP revision incorporating the information provided in its January 24, 2023, May 16, 2023, and January 10, 2024, supplemental letters. Efforts under Enterprise Project Identifier L-2022-DFA-0000 will be closed after the NRC receives this document.
