Dear Christian Williams:

The staff has issued the environmental assessment and Finding of No Significant Impact related to your application for an exemption dated March 22, 2024 (Agencywide Documents Access and Management System Accession Number No. ML24082A008). The proposed action would allow Constellation to load and maintain loaded MPC-37-CBS in the HI-STORM FW MPC Storage System at the Calvert Cliffs Nuclear Power Plant Units 1 and 2 Independent Spent Fuel Storage Installation in the storage condition where the terms, conditions, and specifications in CoC No. 1032, Amendment No. 1, Revision No. 1 are not met, solely as it applies to the nine already loaded and the near-term planned loading of six non-compliant CBS canisters beginning in July 2024. This action, if approved, would be permitted under exemption from Title 10 of the Code of Federal Regulations Part 72, sections 72.212(a)(2); 72.212(b)(3); 72.212(b)(5)(i); 72.212(b)(11) and 72.214.
