Dear Representative Williams:
On behalf of the U.S. Nuclear Regulatory Commission (NRC), I am responding to your March 15, 2024, letter regarding the Fiscal Year (FY) 2024 Proposed Fee Rule.
We appreciate and share your interest in ensuring that the NRCs fee rule is fair and equitable, and the NRC continues to enhance its processes. The NRC held a public meeting on March 7, 2024, to discuss the proposed rule, including the impact of the budget upon fees. The NRC staff will review, consider, and respond to all comments received during the comment period as part of the development of the final fee rule. Your letter is also included in the official record for this rulemaking.
As an example of an NRC effort to make fees fair and equitable, the NRC incorporated a variable fee structure to address the economic differences between the current fleet of large operating reactors and much smaller reactors, typically called small modular reactors (SMRs),
to establish a fair and equitable approach for assessing annual fees for all SMRs. The NRCs initial variable fee structure was focused on light water reactor (LWR) SMRs. In light of increased interest in licensing non-LWRs, including even smaller reactors, the NRC expanded the applicability of the variable fee structure to these types of reactors in the FY 2023 Final Fee Rule.
