NRC RESPONSE TO REQUEST FOR REGULATORY CONFERENCE (TENNESSEE VALLEY AUTHORITY (TVA) - SEQUOYAH NUCLEAR PLANT)

Dear Thomas Marshall:
The NRC has received your letter dated March 28, 2024 (ML24088A033), in which you accepted the opportunity to discuss during a Regulatory Conference a finding and apparent violation that has been preliminarily determined to be of greater than very low safety significance (greater-than-Green, or GTG) related to the failure of the 1B Diesel Generator at the Sequoyah Nuclear Plant in September 2023. In this letter, you also requested an extension beyond the 40-day guidance for the Regulatory Conference Meeting to complete an ongoing 10 CFR Part 21 evaluation. Additionally, you indicated the possible need for 60 days to coincide with the evaluation period in 10 CFR Part 21.21(a)(1) as you believe the results of the evaluation will provide relevant information needed to support the TVA position at the regulatory conference.
The NRC has reviewed your letter, and we decided not to grant your request for additional time to hold a Regulatory Conference. The inspectors have reviewed and incorporated insights from your causal evaluations and risk analyses to arrive at the finding and assess its significance.
Information provided as a result of a 10 CFR Part 21 evaluation is unlikely to differ substantially from information already provided as you have completed your evaluations and analyses of the event. The agency recognizes the importance of the 10 CFR Part 21 process of identification, evaluation, and notification. However, the results of any 10 CFR Part 21 processes will not impact the significance determination associated with the finding and apparent violation concerning the failure of the 1B Diesel Generator at the Sequoyah Nuclear Plant in September 2023. Hence, the NRC has chosen to proceed with scheduling a Regulatory Conference on the previously agreed upon date of May 2, 2024. The specific time and location will be posted to the NRC Public Meeting Schedule.
