Dear Michael Scarpello:

By letter dated January 26, 2023 (Agencywide Documents Access and Management System Accession No. ML23026A284), as supplemented by letters dated August 2, 2023, and February 27, 2024 (ML23214A289 and ML24058A357, respectfully), Indiana Michigan Power Company (I&M, the licensee) submitted a license amendment request for the Donald C. Cook Nuclear Plant, Unit Nos. 1 and 2 (CNP). The proposed amendment would revise Technical Specification (TS) 3.3.3, Post Accident Monitoring (PAM) Instrumentation to remove Function 1, Neutron Flux, from the list of required PAM instrumentation.

In its submittal, I&M requested the U.S. Nuclear Regulatory Commission (NRC) staffs approval commensurate with the NRC's normal review approval schedule, with a 60-day implementation period. On February 21, 2023 (ML23052A150) the NRC staff notified you that your January 26, 2023, request had been accepted for review, and that the NRC staff estimated its review would be completed by February 2024 and take approximately 345 hours0.00399 days <br />0.0958 hours <br />5.704365e-4 weeks <br />1.312725e-4 months <br />. On March 21, 2023, the NRC published a notice of consideration of approval of the application in the Federal Register (88 FR 17036). On November 17, 2023 (ML23321A122), the NRC staff requested additional information to complete the review. On February 27, 2024 (ML24058A357), I&M provided a supplement which revised the scope of the amendment request such that Neutron Flux remains as Function 1 in TS Table 3.3.3-1, but the channels would be not required to maintain environmental qualification. As a result, the June 1, 2022, supplement, provided additional information that expanded the scope of the application as originally noticed. Therefore, the NRC intends to publish a new notice of consideration of approval of the application, as supplemented, in the Federal Register on April 16, 2024. In accordance with Title 10 of the Code of Federal Regulations (10 CFR), Part 2, Section 2.309(b)(3), the Federal Register notice for the proposed issuance of an amendment must provide a hearing request period of at least 60 days.

During a call on April 4, 2024, the NRC staff communicated to I&C that the change in scope would delay in schedule for the subject LAR. The purpose of this email is to officially inform you that the NRC did not complete its review by February 2024, as a result of the licensees expansion in the scope of the application. To account for the unforeseen delay in the schedule, based on the information provided in your submittal, as supplemented, the NRC staff now plans to complete this review by November 22, 2024. Additionally, the NRC staff now estimates that this licensing request will take approximately 945 hours0.0109 days <br />0.263 hours <br />0.00156 weeks <br />3.595725e-4 months <br /> to complete. If there are emergent complexities or challenges in our review that would cause changes to the initial forecasted completion date or significant changes in the forecasted hours, the reasons for the changes, along with the new estimates, will be communicated during the routine interactions with the assigned project manager. The change in the milestone schedule and estimated hours for the LAR was discussed with the Deputy Director for the Division of Operating Reactor Licensing, who approved the schedule change.
