Dear Ms. Ginoux and Mr. Meutcheho:
As you mentioned in e-mail correspondences recently received, the Port Louis Port Authority is requesting proof that the United States (US) Nuclear Regulatory Commission (NRC) only requires a general license import of the radioactive source tantalum into the U.S. by Global Advanced Metals (GAM). The NRC requirements found within 10 Code of Federal Regulations (CFR) 110.27 with Appendix L allows the import of byproduct material, in this case tantalum, if the U.S. consignee is authorized to receive and possess the material under the relevant NRC or Agreement State regulations. A general license does not require specific case-by-case approval by the NRC, but rather approved by regulations. General license information is found in 10 CFR 110.20.
Please accept this official NRC correspondence as authorization that a general import license is acceptable for the importer, GAM, to receive the tantalum material from Port Louis, Mauritius and from Mozambique.
If you have any questions or need additional information, please contact me at Peter.Habighorst@nrc.gov or Gary Langlie at Gary.Langlie@nrc.gov.
Sincerely, Peter J. Habighorst, Chief Export Controls and Non-Proliferation Branch Office of International ProgramsMarch 29, 2024 Signed by Habighorst, Peter on 03/29/24
