Dear Christian Williams:
The staff has issued the environmental assessment and Finding of No Significant Impact related to your application for an exemption dated March 15, 2024 (Agencywide Documents Access and Management System Accession Number No. ML24075A001). The proposed action would allow Constellation to load MPC-68M-CBS in the HI-STORM 100 Cask System at the Quad Cities Units 1 and 2 ISFSI in the storage condition where the terms, conditions, and specifications in CoC No. 1014, Amendment No. 8, Revision No. 1 are not met, solely as it applies to the four near-term planned loading of non-compliant CBS canisters beginning in June 2024. This action, if approved, would be permitted under exemption from Title 10 of the Code of Federal Regulations (10 CFR) Part 72, sections 72.212(a)(2); 72.212(b)(3); 72.212(b)(5)(i); 72.212(b)(11) and 72.214.
