Dear Chris Warren:

The staff has issued the environmental assessment and Finding of No Significant Impact related to your application for an exemption dated May 7, 2024 (Agencywide Documents Access and Management System Accession No. ML24128A157) and supplemented on May 15, 2024 (ML24136A284). The proposed action would allow South Texas Project Nuclear Operating Company to shuffle (relocate) loaded MPC-37-CBS and to load MPC-37-CBS in the HI-STORM FW MPC Storage System at the South Texas Project Electric Generating Station Units 1 and 2 Independent Spent Fuel Storage Installation in the storage condition where the terms, conditions, and specifications in CoC No. 1032, Amendment No. 2, are not met. This exemption solely applies to the shuffling of 10 already loaded MPC-37-CBS in January 2025 and the near-term planned loading of two non-compliant CBS canisters in March 2025. This action, if approved, would be permitted under exemption from Title 10 of the Code of Federal Regulations (10 CFR) Part 72, sections 72.212(a)(2); 72.212(b)(3); 72.212(b)(5)(i); 72.212(b)(11) and 72.214.
