Dear Christian Williams:
The staff has issued the environmental assessment and Finding of No Significant Impact related to your application for an exemption dated February 23, 2024 (Agencywide Documents Access and Management System Accession Number No. ML24054A031), and supplemented on February 28, 2024 (ML24065A292) and March 8, 2024 (ML24068A069). The proposed action would allow Constellation to load and maintain loaded MPC-68M-CBS in the HI-STORM 100 Cask System at the Dresden Unit 2 and Unit 3 ISFSI in the storage condition where the terms, conditions, and specifications in CoC No.
1014, Amendment No. 8, Revision No. 1 are not met, solely as it applies to the four already loaded and the five near-term planned loadings of non-compliant CBS casks. This action, if approved, would be permitted under exemption from Title 10 of the Code of Federal Regulations (10 CFR) Part 72, sections 72.212(a)(2); 72.212(b)(3); 72.212(b)(5)(i); 72.212(b)(11) and 72.214.
