OF AUGUST 9, 2023, PUBLIC MEETING WITH THE NUCLEAR ENERGY INSTITUTE TO DISCUSS U.S. NUCLEAR REGULATORY COMMISSION STAFF COMMENTS ON PROPOSED METRICS FOR A PERFORMANCE-BASED EMERGENCY PREPAREDNESS PROGRAM Meeting Identifier: 20230944 Date of Meeting:

Microsoft Teams Virtual Teleconference Type of Meeting: Observation meeting where attendees can observe the U.S. Nuclear Regulatory Commission (NRC) performing its regulatory function during the meeting and members of the public have the opportunity to ask questions of the NRC staff following the business portion of the meeting.

Purpose of the Meeting: The purpose of the meeting was for the NRC to conduct a public meeting with representatives from the Nuclear Energy Institute (NEI) and industry to discuss the staffs assessment of the recommendations by the NEI in its letter dated May 30, 2023 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML23200A166), on proposed metrics for a Performance-Based Emergency Preparedness Program.

General Details: This was a virtual meeting conducted via the Microsoft Teams platform. The meeting started at 10:00 AM eastern time (ET) and concluded at 11:00 AM ET. A list of meeting attendees is provided below.

Discussion: At the beginning of the meeting, the NRC staff mentioned that the rulemaking for Emergency Preparedness or Small Modular Reactors and Other New Technologies was under Commission consideration, and therefore, no discussion on the rule would be appropriate during the meeting. In addition, the NRC staff asked the NEI representatives if NEI was requesting any endorsement of the letter. The NEI representatives confirmed that NEI is only interested in the NRC comments and feedback at this time.

The NEI representatives provided highlights on eight performance objectives and explained how they were aligned with the language in the final rule. The purpose of each proposed performance objective was discussed along with the metric frequency for assessment, associated drill objectives, and evaluation criteria. The NRC staff provided feedback to the NEI representatives as each performance objective was stepped through during the meeting.

The NEI representatives mentioned that failure to meet the evaluation criteria in one instance does not necessarily mean that the objective is failed entirely, however, that weakness or deficiency should be captured in the corrective action program. Additional details on all the performance objectives are available in NEIs letter dated May 30, 2023.

Public Participation: No comments were made during the public comment period.

Action Items/Next Steps: At the end of the meeting, the NEI representatives communicated that NEI plans to hold an internal task force meeting to discuss NRCs feedback received during the meeting. The NEI representatives stated that NEI also plans to gain industry alignment on what changes need to be made. It was communicated that NEIs next steps would be to finalize the performance indicator framework and issue it for use by applicants.
