RESPONSE TO THE CHICKASAW NATION - REGULATORY IMPROVEMENTS FOR PRODUCTION AND UTILIZATION FACILITIES TRANSITIONING TO DECOMMISSIONING PROPOSED RULE
Dear Ms. Brunso:
Thank you for your letter regarding The Chickasaw Nations comments on the Regulatory Improvements for Production and Utilization Facilities Transitioning to Decommissioning, (NRC-2015-0070; RIN 3150-AJ59) proposed rule. The purpose of this letter is to inform The Chickasaw Nation of how its comments on the proposed rule were addressed by the staff of the U.S. Nuclear Regulatory Commission (NRC) and to provide a status of where the proposed rule is in the NRCs rulemaking process. The NRC is committed to a government-to-government relationship with Tribal Nations and appreciates The Chickasaw Nations comment on the proposed rule.
By letter dated March 28, 2022, (NRC Agencywide Documents Access and Management System Accession No. ML22088A214), the NRC received the following comments from The Chickasaw Nation:
The Chickasaw Nation recommends including tribal governments in sections that list the roles of State and local governments. Your efforts to preserve and protect significant historic properties are appreciated.
The NRC staff considered these comments on the proposed rule. The NRC strives to include Tribal governments in the regulatory process at the same level as State and local governments.
In addition, where the NRC regulations refer to State and local governments, in practice, the NRC considers Tribal governments to be included in the scope of that group. Therefore, the staff did not revise the rule language to add tribal governments.
The staff provided the final rulemaking package to the Commission on January 31, 2024. The Commission will review the package and provide direction to the staff related to the final rule.
We appreciate The Chickasaw Nation providing comments and look forward to future engagement on NRC activities.
