Reply to a Notice of Violation IDAHO STATE UNIVERSITY-U.S. NUCLEAR REGULATORY COMMISSION INSPECTION REPORT NO. 05000284/2023201 AND NOTICE OF VIOLATION

Dear Mr. Miller,

This letter is in response to U.S. Nuclear Regulatory Commission Inspection Report No. 05000284/2023201 and Notice of Violation. During a U.S. Nuclear Regulatory Commission (NRC) inspection conducted from July 31, 2023 to August 3, 2023, the NRC inspector discovered that two Senior Reactor Operators (SROs) with active licenses did not have a biennial medical examination in accordance with Title 10 of the Code of Federal Regulations (10 CFR) 55.53(i). Nether SRO operated the reactor during the period when they were not in compliance with the biennial medical examination requirement.

The reason for the violation was due to two SROs not completing the biennial medical examination as required by the regulations. One SROs previous medical examination was completed on July 8, 2021, while a subsequent medical examination had not been completed by July 8, 2023. The second SROs previous medical examination was completed on July 19, 2021, while a subsequent medical examination had not been completed by July 19, 2023.

Medical exams were subsequently completed on 8/3/2023 and 8/17/2023 to return the SROs to full compliance with the biennial medical examination requirement.

To ensure the biennial medical examinations are completed as required in the future, the following corrective actions have been taken: (1) all ISU reactor personnel received training to emphasize the importance of complying with the regulations; (2) the ISU Reactor Supervisor has implemented an automatic email notification program that will remind reactor operators to have their medical examinations completed within the 2-year time frame; (3) a permanent ISU reactor staff Training Coordinator was hired to keep track of all requalification training requirements, including the biennial medical examination requirement.
