Dear Mr. Semancik:
I am responding to the letter of December 5, 2023, in which Connecticut indicated that the NRC will be provided with a draft application for an Atomic Energy Act, Section 274b Agreement shortly after February 1, 2024. Once the application is submitted, a review team will be designated and ready to review the Connecticut draft application.
Upon receiving the draft application, the team will review it for completeness. The draft application should contain a draft letter of certification and a description of the materials program for all applicable elements of the Agreement. The description should cover all applicable sections of Nuclear Material Safety and Safeguards procedure SA-700 Processing an Agreement. It should contain sufficient information to permit staff to conduct a detailed review of the application. It should also contain the draft text for the proposed Agreement (See NRC Management Directive 5.8, Proposed Section 274b Agreements with States). Printed and photocopied documents must be legible. Information in electronic form must be readable by the agency computer resources. The submittal should not contain any information that is not publicly available, including security related information. In the case of personally identifiable information (PII), it should be provided in a separate submittal that is clearly marked as containing sensitive PII.
During the review, there will be regularly scheduled telephone calls with the State. NRCs comments on the draft application should be used to make changes to the formal request.
However, the State should not submit a second draft or changes to the draft unless coordinated with the Branch Chief of the State Agreement and Liaison Programs Branch. This will help avoid ambiguity with respect to responding to NRC comments and the completeness for the formal request.
