UNITED STATES NUCLEAR REGULATORY COMMISSION WASHINGTON, D.C. 20555-0001 Docket Nos. 50-498 50-499 72-1041 AMENDMENT TO INDEMNITY AGREEMENT NO. B-108 AMENDMENT NO. 9 Effective November 1 , 2023, Indemnity Agreement No. B-108, between STP Nuclear Operating Company, NRG South Texas LP, City Public Service Board of San Antonio, The City of Austin, Texas, Nuclear Innovation North America LLC, NINA Texas 3 LLC, NINA Texas 4 LLC, and the United States Nuclear Regulatory Commission, dated December 29, 1986, as amended, is hereby further amended as follows:

The name "NRG South Texas LP" is deleted wherever it appears in the indemnity agreement.

Item 1 of the Attachment to the indemnity agreement is modified by adding:

Item 1 - Licensee Constellation South Texas, LLC Address 1310 Point Street Baltimore, Maryland 21231 The termination of the South Texas Project Units 3 and 4 Combined Licenses (COLs) requiring changes to the original indemnity agreement and attachments thereof was not previously recorded. Therefore, the following changes are listed here as a matter of record:

On July 12, 2018, the NRC approved the termination of South Texas Project Units 3 and 4, CO Ls NPF-97 and NPF-98, and their included Title 10 of the Code of Federal Regulations Parts 30, 40, and 70 licenses. Therefore, the names "Nuclear Innovation North America LLC," "NINA Texas 3 LLC," and "NINA Texas 4 LLC" and the license numbers NPF-97 and NPF-98 were deleted wherever they appeared in the indemnity agreement.

In light of the above, Indemnity Agreement No. B-108 is between STP Nuclear Operating Company, Constellation South Texas, LLC, City Public Service Board of San Antonio, The City of Austin, Texas, and the United States Nuclear Regulatory Commission.
