As we have previously discussed in person and via telephone, this email serves as an official request to the NRC to update the Southern Nuclear NGA East letter for Vogtle Units 1-3. Our letter is attached for reference. Vogtles letter was the first one issued in the industry and contained a sentence (below in yellow) that other utility letters did not contain. Southern Nuclear is concerned that the wording of the sentence below is unclear and ambiguous and could potentially lead to issues in the future as to action Vogtle should have taken based on this sentence. Please provide written clarification and justification for why the statement in the Vogtle letter is different or consider re-issuance of the letter to match the standard template for the industry.
In addition, we were communicated that the later issued letters will be the new template going forward, sans any site specific information based on the seismic curves. The statement below and in yellow is what SNC is requesting written clarification or removal from our letter to match the industry letters. Let me know if you have any questions.
SNC Statement to be removed:
The NRC staff notes that Southern Nuclear Operating Company is responsible for considering the impact of this updated hazard on its plant-specific licensing basis including, approved risk[1]informed applications, and, if applicable, the approved program for maintaining the plant-specific seismic probabilistic risk assessment supporting such applications.
