NRC REGULATORY CONFERENCE

SUMMARY

Licensee: Dominion Energy Facility: Virgil C. Summer Nuclear Station License No.: NPF-12 Docket No.: 05000395 Date of Conference: November 13, 2023 Meeting No.: 20231234 Enforcement Action: EA-23-093 On November 13, 2023, representatives of Dominion Energy and Virgil C. (V.C.) Summer Nuclear Station met with U.S. Nuclear Regulatory Commission (NRC) personnel in the Region II office located in Atlanta, Georgia, with some NRC staff attending virtually via Microsoft Teams.

The purpose of the regulatory conference was to discuss the apparent violation (AV) documented in NRC Inspection Report Number 05000395/2023090, dated October 4, 2023

[NRC's Agencywide Documents Access and Management System (ADAMS) Accession No. ML23268A467]. The regulatory conference was held at the request of Dominion Energy and was characterized as an NRC Observation public meeting. Public participation in the meeting was via teleconference (dial-in). An attendance list is provided as an enclosure to this summary (Enclosure 1).

NRC representatives discussed the preliminary Yellow finding and associated AV as described in the subject inspection report and provided an overview of NRCs Reactor Oversight Process for significance determination. Dominion and V.C. Summer site representatives led the presentation of their response to the preliminary Yellow finding and AV, as shown in their enclosed presentation (Enclosure 2). Dominion stated that they accepted the performance deficiency and were taking steps to understand the issue and implement corrective actions. The licensee presented updated risk determination information that was not available to the NRCs Significance and Enforcement Review Panel on September 13, 2023. Ultimately, the licensee asserted that the updated risk information supported a final significance determination of White (low to moderate safety significance).

NRC staff communicated it is their goal to complete internal review and deliberations, and communicate decisions made to Dominion within ninety calendar days of the conference. At the close of the business portion of the meeting, members of the public were allowed to ask any relevant questions and interact with NRC participants. There were three interactions with members of the public and the NRC conference participants. Following these interactions, the meeting was adjourned.

In accordance with 10 CFR 2.390 of the NRCs Agency Rules of Practice and Procedure, a copy of this conference summary and enclosures (Enclosure 1 and 2) will be made available electronically for public inspection in the NRC Public Document room or in ADAMS, accessible from the NRC Web site at http://www.nrc.gov/reading-rm/adams.html.
