OF OCTOBER 27, 2023, DRAFT REGULATORY GUIDE (DG)-4034, PUBLIC MEETING On October 27, 2023, the U.S. Nuclear Regulatory Commission (NRC) staff held an information meeting with a question-and-answer session with stakeholders to discuss Draft Regulatory Guide (DG)-4034, General Site Suitability Criteria for Nuclear Power Stations.

The meeting notice is available in the NRCs Agencywide Documents Access and Management System (ADAMS) at Accession No. ML23290A235, and the presentation slides are available under Accession No. ML23298A134. The NRC staff provided information and allotted time for stakeholder comments and questions.

Stakeholders provided feedback on this topic and asked clarifying questions. NRC staff appreciates the feedback provided and no follow-up actions were identified.

Bill Reckley of the NRC staff provided an overview of Appendix A, Alternative Approaches to Address Population-Related Siting Considerations, of DG-4034, General Site Suitability Criteria for Nuclear Power Stations, (ML23123A090). The DG-4034 is the proposed Revision 4 to Regulatory Guide (RG) 4.7 of the same title. The NRC staff explained that its revising RG 4.7 to support licensing for non-light water reactor (LWR) technology and light-water small modular reactors (SMRs) by providing alternatives to the population-density criterion based on estimates of radiological consequences from design-specific events and to provide additional methods that applicants can use to meet the siting requirements of Title 10 of the Code of Federal Regulations (10 CFR) 100.21(h) to ensure consistency in new reactor licensing reviews and promote a more effective and efficient licensing process.

The NRC anticipates three types of advanced reactor applications: (1) non-LWR technologies using the licensing modernization project (LMP) methodology (RG 1.233); (2) LWR technologies using a traditional major accident approach or a deterministic approach to assess the potential consequences from reactor accidents; and (3) non-LWR technologies not using the LMP methodology and choosing to use a traditional or a deterministic approach to establish the requirements for a containment-type barrier for limiting the release of radionuclides. Appendix A provides guidance for estimating offsite consequences to inform the alternative population-related siting considerations for each of these types of applications.

On October 18, 2023, the NRC issued a Federal Register Notice (ML23135A003) announcing publication of DG-4034 for a 30-day public comment period. The public comments were due by November 17, 2023.

During the meeting the NRC staff provided clarifications on the modeling assumptions in the alternative approaches to the population density criterion that have been developed for advanced reactors. The questions from stakeholders were focused on implementation details and whether a conservative analysis was expected. The staff explained that the draft guidance allows for a range of realism in the analysis, with adequate basis and justification. There were questions seeking clarity on using average values for dose calculations that NRC would find acceptable. Stakeholders noted that expectations in this area were not clearly articulated in the guidance and asked if the staff would consider reflecting these expectations on DG-4034 based on the receipt of a formal written comment. The staff encouraged stakeholders to provide written comments by November 17, 2023, and noted that all comments would be considered and resolved prior to finalizing Revision 4 of RG 4.7.

In response to questions regarding siting inside more densely populated areas, the staff clarified that DG-4034 is intended to stay within the bounds of existing regulations and commission direction in this area. The staff explained that applicants should engage with NRC if they would like to propose an exemption in this area. The staff further acknowledged that additional work is being done in this area and pointed to the enclosure in NRC Staff Prepared White Paper -
