BIENNIAL REVIEW OF FEES FOR CRIMINAL HISTORY PROGRAM BACKGROUND CHECKS This correspondence responds to your memo dated October 3, 2023, titled, Biennial Review of Fees for Criminal History Program Checks (Agencywide Documents Access and Management System Accession No. ML23270B964). In your memo, you indicated that you approve a fee decrease to $32.00 for Criminal History Program (CHP) background checks for licensees beginning in fiscal year 2024. We appreciate the Office of the Chief Financial Officers (OCFOs) thorough analysis of our biennial review of administrative charges for the CHP and our recommendation to keep the CHP fee at $35.00. OCFOs analysis was based on the Chief Financial Officer Act and the amount of carryover from the CHP in the prior year, which indicated that a decrease of the fee would be sufficient to ensure reimbursable receipts are adequate to fund the obligation of CHP activities in advance of costs being incurred.
As such, my staff is taking action to notify stakeholders that the CHP fee decrease from $35.00 to $32.00 will be effective February 1, 2024. This will allow time for coordination with the Office of Nuclear Reactor Regulation and the Office of Nuclear Material Safety and Safeguards staff who oversee licensees effected by this change; preparation of a Federal Register notice announcing the change; updates to the U.S. Nuclear Regulatory Commissions public website and associated guidance; and the Department of Treasurys pay.gov system with the new fee information.
