10 CFR 2.206 Petition from Nuclear Energy Oversight Project - Hydrogen Mitigation in Severe Accidents Date:

Wednesday, October 25, 2023 3:02:00 PM Mr. Saporito, This e-mail is to inform you that I will be the Petition Manager for your August 27, 2023, petition. I will keep you informed of the status as the evaluation of your petition progresses.

Please feel free to contact me with any questions about the process and/or the status of the petition evaluation at any time.

In your petition you requested that the Nuclear Regulatory Commission (NRC) take enforcement action against all licensees of commercial boiling water reactors and pressurized water reactors including specific actions against licensees of the AP1000 reactors.

Following evaluation in accordance with Section II.A.2.(c) of MD 8.11, the NRC staff has concluded that there is no imminent safety concern that warrants immediate action.

The NRC staff has concluded that your petition has screened into the 2.206 process in accordance with Section II.A.2(e) of NRC Management Directive (MD) 8.11 Review Process for 10 CFR 2.206 Petitions (Agencywide Documents Access and Management System (ADAMS) Accession No. ML18296A043) and a Petition Review Board (PRB) will begin its evaluation.

As the PRB begins its evaluation I would like to ensure that you are aware that because the 2.206 petition process is a public process, the petition and all the information in it, including your identity, will be made public.

Thanks,

James Kim Project Manager/ 2.206 Petition Core Team Member U.S. Nuclear Regulatory Commission Office of Nuclear Reactor Regulation office: (301)415-4125 James.Kim@nrc.gov Mail Stop O-9B1a, Washington, DC, 20555-0001
