Anthony,

The purpose of this email is to provide the basis for our recommendation to keep the BWXT Nuclear Operations Group Lynchburg inspection program at its current level in accordance with Manual Chapter 2604, Licensee Performance Review. This is in response to the annular organic waste tank overflow event and subsequent issuance of a civil penalty on August 22, 2023, for a Severity Level III violation with two examples. This Program Adjustment Review provides the basis for our recommendation to keep the inspection program at its current level until the next biennial licensee performance review scheduled for 2025.

Program Adjustment Review:

On August 22, 2023, the Nuclear Regulatory Commission (NRC) issued a civil penalty for a Severity Level III violation with two examples (ML23209A827). NRC Region II staff performed a program adjustment review in accordance with Manual Chapter 2604 due to the issuance of a Severity Level III violation.

The staff recommends the NRC maintain its current level of inspection effort for BWXT NOG-L for the following reasons:

1. There was no actual consequence associated with the event, no criticality accident occurred as the result of the overflow event and subsequent introduction of uranium bearing material into the ventilation system.
2. This violation is an example of an isolated and latent design issue and is not indicative of ML23298A004

current licensee performance, the rupture disk in the overflow line stemmed from a design change which occurred back in 2012.

3. A thorough root cause analysis and extent of condition review was performed by the licensee and did not identify other examples of overflow lines like the one which failed in February of 2023.
4. The licensee has implemented short term and long term corrective actions to prevent recurrence including changes to their design review process and setpoint analysis for overflow lines.

At this time, RII staff recommends keeping the NRC inspection program at its current level for BWXT NOG-L. Please respond with your concurrence.
