In October 2021, Kairos Power submitted an Environmental Report (ER) (Reference 1) as part of the Construction Permit Application (CPA) for the Hermes non-power reactor. In February 2023, NRC staff advised Kairos Power that they had received comments in early December 2022 on the NRC draft environmental impact statement (DEIS) from a federally-recognized Tribe. The Tribe requested that a cultural resources survey be conducted for the proposed project site and informed the NRC of its interest in acting as a consulting party under the National Historic Preservation Act (NHPA). The Tribe requested that the NRC include its office in discussions regarding the development of archaeological monitoring and discovery plans for the Hermes site (Reference 2).
Kairos Power provided associated information to supplement the ER (Reference 3) to aid in NRC government-to-government consultations with the Tribe. As a result of subsequent feedback from the Tribe during the consultations, Kairos Power submitted an agreement in principle (Reference 4) for a path forward to reach closure of the consultations. To implement the agreement, Kairos Power contracted a geoarchaeologist, appropriately qualified under Secretary of Interior (SOI) standards pursuant to Appendix A of 36 CFR Part 61, to develop a methodology for and conduct a reconnaissance-level field investigation of the Hermes site and make appropriate updates to the monitoring plan information provided in Reference 3. The results of survey and the monitoring plan are included in Enclosures 1 and 2, respectively, to this letter. Kairos Power will continue to participate in periodic closed meetings with NRC staff to facilitate close coordination on future actions.
Kairos Power requests withholding of Enclosure 1 and Enclosure 2 to this letter in their entirety from public disclosure consistent with 54 USC 307103, and 36 CFR 800.11(c), and 10 CFR 2.390(a)(3). and Enclosure 2 also include geotechnical and geophysical information and data that should be withheld consistent with 10 CFR 2.390(a)(9). When separated from the enclosures, this letter may be released publicly.
