Dear Ralph O. Meyer:

By letter dated August 1, 2022 (Agencywide Documents Access and Management System Accession No. ML22284A087), you submitted a petition for rulemaking requesting that the NRC revise the acceptance criteria for emergency core cooling system performance in Section 50.46 of Title 10 of the Code of Federal Regulations. The purpose of this email is to provide an update on the status of your petition and inform you that there is a public meeting scheduled for October 25, 2023, that may be of interest to you.

On November 23, 2022 (87 FR 71531), the NRC published in the Federal Register a notice of acceptance and docketing of PRM-50-124 and requested comments on the petition. The comment period closed on March 8, 2023, and the NRC received several comment submissions, which can be found at https://www.regulations.gov under Docket ID NRC-2022-0178. The NRC is evaluating your petition and the associated public comments. Once the NRC makes a determination on the petition, the NRC will notify you and publish a notice in the Federal Register explaining the Commissions decision.

On October 25, 2023, the NRC staff will hold a public meeting to discuss the regulatory basis (ML23032A504) for a rulemaking on Increased Enrichment of Conventional and Accident Tolerant Fuel Designs for Light-Water Reactors. The regulatory basis for this rulemaking addresses, in part, issues regarding fuel fragmentation, relocation, and dispersal relevant to fuels of higher enrichment and burnup levels. A copy of the meeting notice is attached. Any updates regarding this meeting, such as changes to the date and time, will be posted online at https://www.nrc.gov/pmns/mtg?do=details&Code=20231108.

In addition, Soly Soto Lugo will be taking over as the project manager for your petition effective October 23. The purpose of this meeting is for the NRC staff to meet directly with individuals to discuss regulatory and technical issues. Attendees will have an opportunity to ask questions of the NRC staff or make comments about the issues discussed throughout the meeting; however, the NRC is not actively soliciting comments towards regulatory decisions at this meeting.

Purpose:

To engage with the public to provide an overview of the increased enrichment of conventional and accident tolerant fuel designs for light-water reactors regulatory basis, the rulemaking process and schedule and answer questions to facilitate meaningful comments on the regulatory basis.
