OF SEPTEMBER 12, 2023, PUBLIC MEETING ON TERMINATION OF U.S. NUCLEAR REGULATORY COMMISSION RECOGNITION OF THE AMERICAN BOARD OF RADIOLOGYS CERTIFICATION PROCESSES Meeting Identifier: 20230929 Date of Meeting: Tuesday, September 12, 2023; 2:00 p.m. EDT Location: Webinar Meeting Participation Level: Information meeting with Question-and-Answer Session Meeting Notice: ML23255A073 Purpose of the Meeting: To provide information on the American Board of Radiologys decision to stop maintaining its U.S. Nuclear Regulatory Commission (NRC) recognition of its certification processes that meet the training and experience requirements under Title 10 of the Code of Federal Regulations (10 CFR) Part 35, after December 31, 2023, and effectively ending the NRCs recognition of its certification processes. Additionally, to provide information on how affected individuals seeking to become Authorized Individuals in the future can apply for authorization.

Background:

The American Board of Radiology (ABR), a major specialty board recognized by the NRC, requested to stop maintaining NRC recognition of their certification processes after December 31, 2023. The NRC has approved and plans to discontinue its recognition, which has been recognized by the NRC since 2005, and will do this formally by letter. The ABR is one of the recognized specialty boards listed on the NRCs Medical Uses Licensee Toolkit Web page, with certification processes for certain specialty areas that meet the NRCs training and experience requirements under 10 CFR Part 35, Medical Use of Byproduct Material.

C. Einberg Once a specialty boards certification process meets the NRC regulations in 10 CFR Part 35, the board is recognized by the NRC or Agreement State. Licensees may submit a licensing action request for any individual certified by that specialty board to become an authorized individual on a radioactive materials medical use license (e.g., physician - authorized user, radiation safety officer (RSO) or associate RSO, authorized medical physicist, or authorized nuclear pharmacist). Although the specialty boards recognized by the NRC are not licensees, the regulations in 10 CFR Part 35 provide a pathway - board certification training pathway -

for individuals training to be reviewed and approved by a recognized specialty board, for possible identification on a license as an authorized individual. The regulations provide another pathway - alternate training pathway - for individuals without an NRC-recognized certificate to have their training documentation be reviewed and approved directly by the NRC or Agreement States, to allow for possible authorization.

General Details: The NRC published the official public meeting notice on August 21, 2023, providing the agenda and webinar registration instructions for attendees (ML23255A073). The staff gave a detailed presentation on the history of the ABRs recognition with NRC, their decision to maintain recognition and what this means for individuals and authorizations, and options and pathways available for individuals seeking to become authorized individuals on a radioactive materials medical use license. The staff also reminded the meeting attendees that there are currently no changes being made to the regulations as a result of the discontinuation.

The staffs presentation is available at ML23254A377. At designated points during the presentations, the staff provided opportunities for meeting attendees to ask questions. The meeting was attended by about 215 people, including NRC staff, medical community representatives, Agreement State representatives, and members of the public. The meeting concluded at 3:23 p.m. EDT. A list of NRC and external meeting participants is enclosed. Below is a summary of the questions and comments received. Summary of Questions and Comments Received:

During the meeting, the NRC received questions and comments related to:

  • Whether the discontinuation only applies to newly ABR-boarded individuals and whether previous and current recognized board certificates will continue to be recognized.
  • NRC recognition of re-certification for individuals with NRC-recognized certificates.
  • Whether there are any NRC-recognized training courses and third-party examination centers.
  • The NRC Form 313A series - whether they will be revised, how to use the forms, and when they should be submitted.
  • NRC recognition of foreign training physicians.
  • Shortage of Authorized Users following the discontinuation.
  • NRC staffing support for anticipated increase in demand for AU request with more individuals seeking authorization via the alternate pathway.
  • Whether the NRC is planning to issue an Information Notice to licensees regarding ABRs decision.
  • Requirement for residency programs to complete and maintain records of individuals training and experience and preceptor attestation using the NRC 313 forms.

C. Einberg Next Steps: The NRC will issue a letter to the ABR before the discontinuation goes into effect on December 31, 2023. The NRC staff will update the list of recognized specialty boards on the NRCs Medical Uses Licensee Toolkit Web page to indicate the ABRs recognition status and update the sample certificates once the discontinuation is in effect. The NRC staff will communicate the discontinuation to medical licensees and the public via NRC generic communications, the NRC medical list server, and an announcement posted on the NRC's Medical Uses Licensee Toolkit Web page.
