WESTINGHOUSE ELECTRIC COMPANY, LLC - REVISION TO TEMPORARY LICENSE CONDITIONS FOR SAMPLING, ANALYSIS, AND DISPOSITION OF HEMATITE ASH MATERIAL PHASE II ABOVE LICENSE LIMITS (ENTERPRISE PROJECT IDENTIFIER L-2023-LLA-0089)

Dear Jeffrey Ferguson:

The U.S. Nuclear Regulatory Commission (NRC) reviewed the application from Westinghouse Electric Company, LLC (Westinghouse or WEC) requesting sampling, analysis and disposition of Hematite ash. The application for the treatment of the ash was transmitted by letter dated June 9, 2023 (Agencywide Documents Access and Management System (ADAMS) No.

ML23160A261). A Safety Evaluation Report documenting the basis for the NRCs findings for the sampling, analysis and disposition of Hematite ash is provided in Enclosure 1.

The NRC staff has completed its review of the June 9, 2023, request. As a result, the two license conditions (S-19 and S-20) that had been added by the NRCs review of a prior request for temporary permission to store the Hematite ash potentially in excess of 5 weight percent enrichment (December 2, 2022 application at ML22336A174 and May 5, 2023 approval at ML23094A158) are modified to allow sampling, analysis and disposition of the Hematite ash material. These license conditions will be removed upon completion of the campaign. The text of the revised license conditions are:

License Condition S-19: The licensee shall use the methods described in the June 9, 2023, application to sample, analyze and disposition the 55-gallon drums containing Hematite ash in excess of 5.0 wt.% 235U.

License Condition S-20: The licensee shall maintain at least 12 inches edge-to-edge spacing between 55-gallon drums containing Hematite ash in excess of 5.0 wt.% 235U and all other fissionable material during the sampling, analysis and disposition of this material.

This action closes activities under Enterprise Project Identifier L-2023-LLA-0089.

Documents transmitted by this letter contain Security-Related Information. When separated from Enclosure 3, this letter and enclosures 1 and 2 are decontrolled.
