TERRESTRIAL ENERGY USA, INC. - ACKNOWLEDGEMENT LETTER FOR WITHDRAWAL OF THE TECHNICAL REPORT, UNCERTAINTY QUANTIFICATION METHODOLOGY FOR CALCULATION OF IMSR OFF-GAS SOURCE TERM REVISION 0 AND WITHHOLDING PROPRIETARY INFORMATION FROM PUBLIC DISCLOSURE FOR THE TECHNICAL REPORT, UNCERTAINTY QUANTIFICATION METHODOLOGY FOR CALCULATION OF IMSR OFF-GAS SOURCE TERM REVISION 1

Dear Mr. Hill:

By letter dated July 26, 2023 (Agencywide Documents Access and Management System Accession No. ML23228A045), and submitted to the to the U.S. Nuclear Regulatory Commission (NRC) on August 25, 2023, Terrestrial Energy USA (TEUSA) requested to withhold the information contained in the following document from public disclosure pursuant to Title 10 of the Code of Federal Regulations (10 CFR) Part 2, Section 2.390, Public Inspections, Exemptions, Requests for Withholding:

UNCERTAINTY QUANTIFICATION METHODOLOGY FOR CALCULATION OF IMSR OFF-GAS SOURCE TERM - REVISION 1 The subject technical report supersedes the previous version and therefore you have requested to formally withdraw the previous version of the Technical Report, Uncertainty Quantification Methodology for Calculations of IMSR Off-Gas Source Term Revision 0.

The affidavit stated that the submitted information should be considered exempt from mandatory public disclosure for several reasons including but not limited to:

The information sought to be withheld is considered commercially sensitive as it discloses process, method, or apparatus, including supporting data and analyses that could constitute a competitive advantage.

TEUSA is transmitting the information to the Commission in confidence, and, under the provisions of 10 CFR 2.390, the Commission is to receive it in confidence.

Public disclosure of the information sought to be withheld is likely to cause substantial harm to TEUSAs competitive position and foreclosure or reduce the availability of profitmaking opportunities.

D. Hill The NRC staff has reviewed the affidavit and the subject material in accordance with the requirements of 10 CFR 2.390 and, on the basis of the statements in the affidavit, has determined that the submitted information sought to be withheld contains proprietary commercial information and should be withheld from public disclosure.

Therefore, the NRC staff will withhold the versions of the submitted information marked as proprietary from public disclosure pursuant to 10 CFR 2.390(b)(5) and Section 103(b) of the Atomic Energy Act of 1954, as amended.

Withholding the submittals from public inspection will not affect the right, if any, of persons properly and directly concerned to inspect the documents. If the need arises, the NRC may send copies of the information to its consultants working in this area. The NRC will ensure that the consultants have signed the appropriate agreements for handling proprietary information.

If the basis for withholding this information from public inspection should change in the future such that the information could then be made available for public inspection, TEUSA should promptly notify the NRC. TEUSA also should understand that the NRC may have cause to review this determination in the future, for example, if the scope of a Freedom of Information Act request includes TEUSA information. In all review situations, the NRC staff will follow applicable laws, regulations, and policies in conducting its review, including the NRCs policies on notifying the owner of information in advance of any public disclosure.
