FYI for tomorrow's PSM meeting Hi Amy and Jamie, As you know, we have the presubmittal meeting tomorrow on the proposed Tier 1 and 2* exemption.

Over the last week, weve collected input from the staff on the changes to the proposed LAR, and I wanted to give you a heads up regarding the primary questions we plan to ask SNC tomorrow.

1. In reviewing the history of previous, related requests, the proposed change described in the draft looks more similar in scope to what was proposed in LAR 14-008, which proposed treating all Tier 2* information as Tier 2 information, than what was proposed in LAR 17-037, which established a license condition to provide for screening certain Tier 2* information to see whether NRC approval was needed prior to changing it. SNC withdrew LAR 14-008 after submittal, and the meeting summary (ML14324A077) says, in part, the staff questioned if an LAR process is the appropriate regulatory tool for addressing this issue. Because of implications on other AP1000 COL holders and applicants as well as other certified designs, the rulemaking process may be a more appropriate regulatory tool. In addition, the request touches on significant policy and safety questions. We also observed that there are some statements in the draft that appear to present justification for a generic change to the design certification rule, and there may be implications for other Part 52 applicants. We do plan to ask whether SNC has considered making a petition for rulemaking for the proposed changes.
2. The staff would also like to better understand the use of the integral to NRC approval of methodology designation and how SNC envisions it would be applied, and what benefits that would achieve in lieu of retaining Tier 2* designation.
