ACKNOWLEDGMENT OF RECEIPT OF NUCLEAR ENERGY INSTITUTE (NEI) TECHNICAL REPORT NEI 22-01, LICENSE TERMINATION PROCESS (EPID L-2023-NFO-0010)
Dear Bruce Montgomery:
By letters dated February 13, 2023 and April 11, 2023 (Agencywide Documents Access and Management System (ADAMS) Accession Nos. ML23045A322 and ML23102A030, respectively), the Nuclear Energy Institute (NEI) submitted technical report NEI2201, License Termination Process, on behalf of its members for U.S. Nuclear Regulatory Commission (NRC) review and endorsement. NEI 22-01 was developed to assist decommissioning reactor licensees in the development of License Termination Plans (LTPs) that satisfy NRC requirements and provide an approach that aligns with previously published NRC guidance.
At this time, the NRC does not intend to endorse this document. However, the NRC staff recognizes the potential benefits of NEI 22-01 for establishing consistency across the industry and improving the quality of future LTP submittals. This document could help increase the efficiency and effectiveness of our licensing reviews and inspection activities associated with the license termination process. Therefore, the NRC plans to review and provide observations for NEI and industry consideration. By separate correspondence, you will be advised of any further information needed to support our review by separate correspondence.
Based on the information provided in your submittal and discussions during a public meeting on November 16, 2022, the NRC staff has estimated that our review will take approximately 1010 hours0.0117 days <br />0.281 hours <br />0.00167 weeks <br />3.84305e-4 months <br /> to complete. The NRC staff expects to complete this review by approximately June14,2024. These estimates are based on the NRC staffs initial review of the request and they could change, due to several factors including requests for additional information, and unanticipated addition of scope to the review.
On June 21, 2023 (ADAMS Accession No. ML23103A329), the NRC approved NEIs fee exemption request related to our review of NEI 22-01. The fee exemption granted will be reevaluated six months from the date of the letter issued by the Chief Financial Officer to determine if the activities associated with NEI 22-01 should continue with a fee exemption.
The NRC staff considers this time to be sufficient to allow NEI to respond to any future requests for additional information. The Chief Financial Officer will determine whether to continue with a fee exemption based on whether the approach described in NEI 22-01 would assist the NRC in generic regulatory improvement.
