The Nuclear Regulatory Commission reached out to the Advisory Council on Historic Preservation by letter dated May 9th, 2023, to initiate Section 106 consultation for the Abilene Christian University Molten Salt Research Reactor (ACU MSRR) Construction Permit Application. ACHP responded to the letter on June 12th, 2023, with a request for more information. The request asked for the information under the pretense that the NRC had been notifying the ACHP of an adverse effect. At the time of NRCs initial submission to the ACHP, NRC had not made a determination of Adverse Effect on Historic Properties, whether above or below ground, for the ACU MSRR Construction Permit Application. A submission with additional information and photographs of the historic age building that has been identified within the APE was sent to the ACHP through an e106 submission on August 8th, 2023. No response was received from the ACHP within the 15-day period following submission of this information.
NRC would like to clarify that the proposed action is to license the construction of a research reactor within a building that has already been constructed. No new buildings are being constructed as part of the proposed action. A determination will be forthcoming in the environmental assessment.
NRC is requesting an updated letter from the ACHP pertaining to the verification of the undertaking and whether ACHP has any further intention of participating in Section 106 consultation.
