Dear Chair Rodgers:
On behalf of the U.S. Nuclear Regulatory Commission (NRC), I am responding to your September 1, 2023, letter requesting information about the NRC's implementation of the changes to the National Environmental Policy Act (NEPA) included in the Fiscal Responsibility Act (FRA), which was signed into law on June 3, 2023.
As described in the enclosure to this letter, the NRC staff is actively working to conform its processes and environmental reviews to the new NEPA statutory requirements included in Section 321 of the FRA. The staff is considering the new requirements in each of its individual licensing reviews and determining what actions, if any, may be needed to meet those requirements. The staff is also analyzing whether additional regulatory, rulemaking, or other actions may be required.
In addition, the NRC has been engaged in streamlining efforts for its environmental reviews. These efforts align with the spirit and goals of the NEPA amendments in the FRA and should facilitate the agency's compliance with the new statutory requirements.
