In accordance with the guidance in section 2.9.1a) of Division Instruction LIC-FM LIC-FM-3, Requests for Additional Information, Revision 0, on Thursday, August 3, 2023, the U.S.
Nuclear Regulatory Commission (NRC) staff held a conference call with GE Hitachi (GEH) to discuss, prior to its issuance, a request for supplemental information (RSI) regarding the review of the 2022 decommissioning funding plan and decommissioning cost estimate (DFP/DCE) update for the Vallecitos Nuclear Center (VNC, license number SNM-960) -
EPID L-2023-DFA-0005.
During the call the NRC staff noted that the RSI was being issued to obtain additional information that was still needed prior to proceeding with the technical review of the DFP/DCE. The RSI was to be issued following the discussions during the call.
During the discussions, GEH, however, noted that it is in the process of submitting a request for NRC consent for the direct transfer of the NRC licenses for the facility from GEH to NorthStar Group Services, Inc. (NorthStar). GEH stated that this request will be submitted within the next few weeks and that, as part of that request, it will be submitting information to address the financial assurance for decommissioning requirements which NorthStar will revise. GEH further stated that, in view of this submittal, the NRC review of the 2022 DFP/DCE update would not be necessary since a totally new decommissioning financial assurance mechanism will be submitted in support of the licensee transfer request.
In view of this information, GEH and the NRC staff agreed that GEH will provide a written response to the NRC staffs, June 16, 2023, notification letter to GEH on the detailed tech review of the 2022 VNC DFP/DCE update (ML23156A261) documenting the above discussed information. As such, the staff is placing the issuance of the RSI on hold until receiving and evaluating GEHs response to the June 16, 2023, letter.
In accordance with Title 10 of the Code of Federal Regulations, Section 2.390 of the NRCs Agency Rules of Practice and Procedure, a copy of this communication will be available electronically for public inspection in the NRC Public Document Room (PDR) or from the Publicly Available Records component of the NRCs ADAMS.
