PART I.B -- INFORMATION NOT LOCATED OR WITHHELD FROM DISCLOSURE We did not locate any agency records responsive to your request. Note: Agencies may treat three discrete categories of law enforcement and national security records as not subject to the FOIA ("exclusions"). See 5 U.S.C. 552(c). This is a standard notification given to all requesters; it should not be taken to mean that any excluded records do, or do not, exist.

We have withheld certain information pursuant to the FOIA exemptions described, and for the reasons stated, in Part II.

Upon receipt of your request, we tasked the Offices of the General Counsel (OGC), Nuclear Regulatory Research (RES),

Nuclear Reactor Regulation (NRR), Nuclear Material Safety and Safeguards (NMSS), and Region 1. Our first interim response addressed the records located by OGC, RES, NRR, and Region 1. Our second interim response addressed the records located by NMSS. As a result of searches by these offices, a number of records originating with the Office of the Secretary to the Commission (SECY) were located and referred to SECY. SECY was also asked to conduct a search for any additional responsive records. Our third interim response addressed some of the records located in SECY's search.

The fourth interim response addressed all but three of the remaining records that SECY had located, including several records for which NRR's equities had to be ascertained.

In a telephone conversation with this office today, we discussed with you the three remaining records, all of which are multi-subject records: a single page from an annual rulemaking report (dated May 2019), and two briefing books from 2018 and 2019. All three of these records include brief summaries pertaining to the C-10 rulemaking petition filed by your client, which is the subject matter of your request, and the then-current status of that petition. You agreed to exclude these remaining records from the scope of your request, allowing us to issue this fifth, and final, response to your request at this time.
