Kathryn, We are expecting to send the rule to the Office of the Federal Register (OFR) on 8/1 (Tuesday).

Typically, the OFR will publish the Federal Register Notice for the rule 2-3 days following receipt. At this time, Id expect publication either 8/4 or 8/7 but wont know for sure until we get confirmation from the OFR.

Good afternoon Ms. Hyam,

You previously corresponded with Louise Lund who retired at the end of April. As the new NRC Standards Executive, I look forward to working with you.

We are in the process of finalizing the proposed code edition rule and we expect to publish the proposed rule the week of 7/31/23. I will confirm the exact date with ASME as we get closer to the publication date.

Would you please confirm that we have the correct the URL site for public access to the ASME Code at http://go.asme.org/NRC-ASME. We will need to include this information in the Federal Register Notice when we send the proposed rule to the Office of the Federal Register for publication.

Ms. Hyam,

The purpose of this email is to request that the American Society of Mechanical Engineers (ASME) provide limited public access to the 2021 Edition of the Boiler and Pressure Vessel (BPV) Code,Section III, Division 1,Section XI, Division 1, and the 2022 Edition of the Operation and Maintenance Code, Division 1: Section IST which are to be incorporated by references into § 50.55a of Title 10 of the Code of Federal Regulations Codes and Standards.

In the near future, the U.S. Nuclear Regulatory Commission (NRC) plans to publish in the Federal Register a proposed rule to incorporate by reference the 2021 Edition of the BPV Code,Section III, Division 1,Section XI, Division 1 and the 2022 Edition of the OM Code, Division 1: Section IST. We are requesting that ASME provide members of the general public with read-only access to Section III (including Subsection NCA; and Division 1 subsections NB through NG and Appendices) and Section XI, Division 1 of the 2021 Edition of the BPV Code and Division 1: Section IST of the 2022 Edition of the OM Code during the comment period for the proposed rule. ASMEs fulfillment of this request will help the NRC satisfy the Office of the Federal Register requirements in 1 CFR Part 51 regarding agency requests for approval to incorporate by reference into the CFR materials already published elsewhere.

The planned target date for publication of the proposed code edition rule is 8/16/23 for a 75 day public comment period (8/16/23-10/30/23). Please note the schedule is subject to change. No later than 30 calendar days before the planned publication date, NRC staff will contact you with an update on the schedule and to make final arrangements.
