August 9, 2023 Mr. Duane R. Quayle EnergySolutions Services, Inc.
Bear Creek Operations 1560 Bear Creek Road Oak Ridge, TN 37831-2530
Dear Mr. Quayle:
In an e-mail to the U.S. Nuclear Regulatory Commission (NRC) dated August 3, 2023, you requested to withdraw EnergySolutions Services, Inc. pending application for an amendment to export license XW018/02, requesting to add Intermediate Foreign Consignees to perform shipping services only; this additional shipping information is not required per 10 CFR 110.32(d).
The license authorized the export of class A radioactive waste consisting of hearth ash from incineration of dry active material from Germany. Once processed, it will be returned to the German supplier for ultimate disposal. These materials include those which cannot be incinerated, those that were processed for volume reduction, and the quantity of radioactive waste authorized for export shall not exceed that which was imported from Germany. The NRC is acknowledging receipt of your request and will discontinue further review of application XW018/03. In response to your e-mail, the NRC is returning the application to EnergySolutions Services, Inc. without action. Please note that XW018/02 is currently active until December 31, 2026.
If you have additional questions regarding this letter or the original application, please contact Ms. Joanne Savoy at (301) 287-9092.
Sincerely, Digitally signed by Peter J. Peter J. Habighorst Habighorst Date: 2023.08.09 16:24:22 -04'00' Peter J. Habighorst, Chief Export Controls and Nonproliferation Branch Office of International Programs
