SUMMARY

OF CLARIFICATION MEETING WITH TMI-2SOLUTIONS, LLC REGARDING THE PROCESS FOR CONSULTATION UNDER SECTION 106 OF THE NATIONAL HISTORIC PRESERVATION ACT OF 1966 AS RELATED TO THE HISTORIC AND CULTURE RESOURCES REVIEW LICENSE AMENDMENT REQUEST TO: Shaun Anderson, Chief, Reactor Decommissioning At the request of TMI-2Solutions, LLC (TMI-2S), the licensee for the Three Mile Island Nuclear Station, Unit No. 2 (TMI-2), the U.S. Nuclear Regulatory Commission (NRC) held a clarification call on the subject topic on June 12, 2023, with TMI-2S and the Commonwealth of Pennsylvanias State Historic Preservation Office (SHPO). The purpose of the meeting was to ensure the TMI-2S understands certain aspects of the National Historic Preservation Act of 1966 (NHPA) Section 106 process in relation to the February 27, 2023, License Amendment Request (LAR) for Historic and Cultural Resources Review (ML23058A064).

The meeting began with introductions of the attendees followed by opening remarks. A list of attendees is provided in the attachment. Highlights of the meeting are summarized below.

TMI-2S stated that it received the same questions from the SHPO that the NRC staff received on this undertaking. TMI-2S asked if it should respond directly to the SHPO or to the NRC or if NRC is going to reproduce the questions from SHPO as Request for Additional Information (RAIs). NRC responded that that TMI-2S should respond directly to the SHPO. Currently, NRC has no additional RAIs. The SHPO said that TMI-2S should respond directly using the TMI-2 PA-SHARE site.

TMI-2S requested clarification on what the undertaking is under NHPA Section 106 and how it differs from the NRCs environmental assessment (EA) review process for the LAR. The NRC stated that the Section 106 process gives interested parties, and the public the chance to weigh in on these matters before a final decision is made. This process is an important tool for citizens to lend their voice in protecting and maintaining historic properties in their communities. Also, NRC said that the undertaking is the environmental impact of the TMI-2 building demolition on historic properties. At TMI-2, the buildings are eligible for inclusion on the National Registry of History Places and therefore NRC stated that it must treat them as if they were already listed.

The NRC staff then proceeded to review a Section 106-flow chart with TMI-2S that is located on the Advisory Council for Historic Preservations website.

Under the Section 106 process for identification of historic resources and assessment of adverse impacts, the SHPO needs to understand how the TMI-2 is different, if at all, from other commercial reactors that are undergoing decommissioning before the TMI-2 reactor accident in 1979. The NRC explained that the EA review process is separate from the Section 106 process.

The NRC must review the LAR and assess the potential environmental impacts from the proposed action (phase 2 decommissioning or building demolition at TMI-2). NRC will need to address the environmental impacts on the site specific cultural and historic resources that were not addressed under the previous EAs or Environmental Impact Statements for TMI-2.

2 The SHPO agreed to provide the status summary of the TMI-2 Section 106 consultation. This was provided after the meeting ended (ML23171A718). Also in its email, the SHPO provided a link to the flow chart that NRC discussed during the clarification call. This link is:
