SUMMARY
OF JUNE 13, 2023, PUBLIC MEETING FOR THE NUCLEAR REGULATORY COMMISION STAFF TO PROVIDE AN OVERVIEW OF THE DG-3057, WEATHER-RELATED ADMINISTRATIVE CONTROLS AT INDEPENDENT SPENT FUEL STORAGE INSTALLATIONS.
PURPOSE:
For the U.S. Nuclear Regulatory Commission (NRC) staff to provide an overview of the draft Regulatory Guide (DG), DG-3057, Weather-Related Administrative Controls at Independent Spent Fuel Storage Installations. The meeting was noticed on June 01, 2023 (Agencywide Documents Access and Management System [ADAMS] Accession No. ML23157A015).
MEETING
SUMMARY
On July 13, 2023, the NRC staff held an observation public meeting to provide an overview of the DG-3057 which was issued on June 5, 2023, for a 30-day public comment period. The DG was developed as a result of Nuclear Energy Institute (NEIs) request for the NRC to review and endorse its NEI-22-02, Revision 2, Guidelines for Weather-Related Administrative Controls for Short Duration Outdoor Dry Cask Storage Operations. There were more than 60 attendees, including the NRC, NEI, utilities, and members of the public. The discussion followed the agenda provided in Enclosure 1. Zimmerman Following introductions and opening remarks, the NRC staff gave its presentation to inform the public about the NRCs development of the DG-3057, to ensure that the public understands the main topics to be covered in the DG, how comments can be submitted via the regulatory guidance process, and the proposed schedule. The staff explained that the NRC is considering issuing a new regulatory guide that will provide guidance to the industry on an additional option for complying with certain requirements for spent fuel storage licensees in Title 10 of the Code of Federal Regulations (10 CFR)
Specifically, this new guidance would address that the NRC staff considers acceptable to comply with protection against environmental conditions and natural phenomena. This would be considered acceptable by NRC staff, in certain limited situations, for licensees (specific or general) of an independent spent fuel storage installation and certificate of compliance holders.
The staff also discussed the NRC review of NEI-22-02, Guidelines for Weather-Related Administrative Controls for Short Duration Outdoor Dry Cask Storage Operations, and its endorsement via a regulatory guide (RG). The RG will endorse NEI 22-02, Revision 2, with clarifications and exceptions. The staff believe these are necessary to ensure adequate guidance to ensure safe operation and to meet industry needs. The staff further described each of the clarifications and exceptions.
After the business portion of the meeting, members of the public participating by phone/webinar were given the opportunity to ask questions and make comments to the NRC staff. The staff received several comments such as some sites are located too far from the nearest National Weather Service forecast location to be useful, the guidance doesnt say enough about how to use benchmarking to figure the duration of an operation, the guidance does not consider how a short-term operation can be interrupted by staffing, such as the unavailability of a crane operator in the middle of an operation.
The message conveyed during the meeting was well received and NEI staff commented that they appreciated the NRC staff for conducting the meeting. In general, the public was aligned with the DG, but was interested in the NRC providing more detail on several clarifications which are related to regulatory requirements, as well as and an exception, which is related to implementation. The NRC staff informed the attendees that questions and feedback are welcomed, but that formal comments would not be accepted at this meeting. The staff encouraged the public to submit comments following the process outlined in the June 5, 2023, Federal Register Notice. The NEI stated that written comments will be submitted and that they look forward to having the comments considered and addressed.
The meeting was adjourned at 12:00 p.m. No regulatory decisions were made at the meeting.
