SUMMARY

OF THE JUNE 15, 2023, PUBLIC MEETING WITH NUSCALE POWER AND CARBON FREE POWER PROJECT REGARDING CARBON FREE POWER PROJECT LICENSE STRUCTURE The U.S. Nuclear Regulatory Commission (NRC) staff held a virtual observation public meeting with NuScale Power, LLC (NuScale) and Carbon Free Power Project, LLC (CFPP) on June 15, 2023. The purpose of this meeting was for NuScale to present its preferred approach for the license structure of the 6-module NuScale small modular reactor plant that CFPP plans to build and operate at Idaho National Laboratory.

The notice for this public meeting was posted on the NRC public website on May 23, 2023, and can be accessed on Agencywide Documents Access and Management System (ADAMS)

Accession No. ML23146A200. NuScales presentation slides were made available to members of the public prior to the meeting1.

NuScale/CFPP began its presentation by providing an overview of three NRC Commission Papers that NuScale/CFPP had used to determine which license structure would best meet its needs. Specifically, NuScale/CFPP stated that it had considered information in SECY-10-0034, Potential Policy, Licensing, and Key Technical Issues for Small Modular Nuclear Reactor Designs, (ML093290245), SECY-11-0079, License Structure for Multi-Module Facilities Related to Small Modular Nuclear Power Reactors, (ML110620459), and SECY-14-0095, Status of the Office of New Reactors Readiness to Review Small Modular Reactor Applications, (ML14073A710).

NuScale/CFPP stated that it has selected a similar option to Alternative 3b in SECY-11-0079 in that the NRC would issue a separate license for each NuScale power module (NPM), with common structures, systems, and components (SSC) incorporated in the appendix of each license. NuScale/CFPP stated that it selected this license structure option because it has lower risk and regulatory burden, and would provide full license duration for each module.

NuScale/CFPP continued its presentation by identifying two areas for further engagement and discussion with the staff. These areas include: (1) format and content of the common SSC, and (2) common inspections, tests, analyses, and acceptance criteria. For instance, NuScale identified whether operational programs for the entire six NPMs can be included in the license for the first module. The CFPP team confirmed that the CFPP combined license application will reflect the license structure presented during the meeting.

The NRC staff asked clarifying questions during NuScale/CFPPs presentation on their proposed license structure for CFPP and agreed to hold additional public meetings to discuss NuScale/CFPPs questions. Before concluding the meeting, the staff opened the meeting to members of the public for questions or comments, however, the staff received no questions or comments from members of the public in attendance.
