Dear Yoav Kimchy:
I am responding to your request to withdraw the petition for rulemaking dated August 10, 2022, that you submitted to the U.S. Nuclear Regulatory Commission (NRC). The petition requested that the NRC revise its regulations under Part 20 of Title 10 of the Code of Federal Regulations ( 10 CFR) to permit the disposal of Check-Cap's C-Scan capsule into the sanitary sewer system. On June 13, 2023, the NRC received your request to withdraw the petition for rulemaking (Agencywide Documents Access and Management System Accession No. ML23165A037). In response to your request to withdraw, the NRC will no longer consider your petition for docketing as a petition.
Jo n M. Moses, Deputy Director Division of Rulemaking, Environmental, and Financial Support, Office of Nuclear Materials, Safety and Safeguards
