SUBMITTAL AND REVIEW OF LICENSING TOPICAL REPORTS IN SUPPORT OF CARBON FREE POWER PROJECT COMBINED LICENSE APPLICATION

Dear Mr. Volkoff:

During recent preapplication engagements with NuScale Power, LLC (NuScale) and Carbon Free Power Project (CFPP) on topics related to emergency planning and mitigation of beyond-design-basis events, NuScale has informed the U.S Nuclear Regulatory Commission (NRC) staff that NuScale plans to submit three topical reports (TRs) that would be referenced in or support the NRC staffs review of CFPP combined license application (COLA). These TRs are titled, Emergency Action Level Scheme, On-Shift and Emergency Response Organization Staffing, and Mitigation of Beyond-Design-Basis Events. As communicated to the staff, NuScale plans to submit the TRs between August 2023 and before the end of calendar year 2023.

The NRC staff would like to note that these TRs include substantive and complex information that is necessary for the CFPP COLA review, and that these TRs may require more than a year to complete. As a result, the staff will require that each of these TRs be accepted for review before the CFPP COLA will formally be accepted for review. This guidance and criteria would also be applied to any other TRs submitted during the COLA pre-submittal timeframe that are not identified above.

Consistent with NRC practice, the review schedule and estimated staff hours for these TRs will be established at the time of acceptance and will be incorporated into the overall schedule and hours for the COLA review. If, during the technical review of any of the TRs, it is determined that their review schedules need to be extended, an evaluation on the impact to the CFPP COLA schedule will also be conducted. Thus, the timely completion of the technical reviews for each of the TRs will be essential in maintaining the review schedule for the CFPP COLA.
