This is in response to the communications from Mr. Richard P.

Grill, Waste Management Branch, Division of Radiation Programs and Earth Sciences, Office of Nuclear Regulatory Research, regarding the petition (PRM-30-55) filed by the New Jersey State Department of Environmental Protection.

After reviewing the original justification for the petition to ~RC and the current status of the major by-product facility that was the basis for the petition, we are of the opinion that the situation which previously existed already has been resolved.

Also, the proposed revisions to 10 CFR 20 would address some of the more general concerns of the petition. Therefore, the State of New Jersey is no longer interested in pursuing this matter and hereby withdraws the petition.
